BATFE Loses to Rocketeers in Court
"The problem in this case is that ATFE's explanation for its determination that APCP deflagrates lacks any coherence. We therefore owe no deference to ATFE's purported expertise because we cannot discern it. ATFE has neither laid out a concrete standard for classifying materials along the burn-deflagrate-detonate continuum, nor offered data specific to the burn speed of APCP when used for its 'common or primary purpose.' On this record, the agency's decision cannot withstand judicial review."
In case there is any misunderstanding, the U. S. Court of Appeals in Washington, DC told the BATFE that they did not know what they were talking about, that they had no case, and sent them packing.

Gee, the ATFU reached a conclusion unsupported by fact (Whooda thunk it?!!) and not too gently told the court that they were the experts, and knew what they were talking about, therefore the court had to rule in their favor.
The honorable court called their bluff this time. ATFU's straight turned out to be a busted flush - again, as usual. As is all too well known in the firearms community, they simply don't know what they are talking about. ATFE's standard tactic for replying to questions concerning their 'scientific' procedure and rationale for making determinations(I personally go with the 'dartboard in the office'
theory) didn't work this time. May we see many happy repeats of this!
This is good news on several levels, not the least of which is my budding model rocketry hobby.
