Police are stating they do not plan to charge the shooter, 24 year old Brian Correa.
"It was apparent to us that he was defending himself," said police spokesman Sgt. Gabe Trevino. The medical examiner's office identified the dead man as Tomas Garza.Witnesses state Garza swerved his Mitsubishi Lancer behind Correa's Chevrolet Camaro around 1 a.m. Tuesday, aggressively trying to hit the Camaro. The cars were forced to a stop at a traffic light, and Garza got out of his vehicle with a baseball bat. He hit the Camaro several times with the bat, according to the police report.
Correa ordered Garza to stop, but Garza advanced towards him. Correa defended himself, shooting Garza three times. "I'm still really shaken up. I don't really want to talk about it at all," Correa told a reporter when contacted at his home. The wailing Wilma's have yet to emerge.
Poor guy - forced to make that ultimate hard decision - but he probably saved his own life there. The dead guy was clearly a maniac, and it's just that his intended victim was able to defend himself. Machismo on the roadways can be a very scary thing.

ReplyDeleteMr. Hale was the first Texas CHL holder to use his concealed handgun in lethal self defense not long after the law went into effect in 1996. He was attacked by a road-rager who used nothing but his bare fists, punching Hale through his car window several times before Hale shot him.
Mr. Hale was no-billed, but he suffered permanent nerve damage to the left side of his face.
